MLB HAS REASON TO PURSUE TRADEMARK DISPUTE AGAINST OVERWATCH LEAGUE LOGO?
Blizzard decided to go with a pretty simple logo design for there Overwatch League, a logo design that utilizes negative space, gray on the left side and orange on the right which reveals a Overwatch character in the center. A logo which is pretty similar to the NBA and MLB logos. MLB is now considering a lawsuit because they believe the logo is to similar to theirs and infringes on the trademark.
On March 28, 2017 Overwatch league had their logo approved for trademark but with every new trademark there is a standard month for anyone who wants to oppose the logo because they believe it is similar to theirs or requested more time to determine whether the design somehow a copy of an existing trademark before the trademark is registered. Now the trademark office granted MLB the extension of 90 days and that extension will soon come to an end.
As of now there has been no official word that MLB has entered there reasoning behind why they believe the Overwatch logo is similar to theirs and why the trademark registration should be denied. Who knows what they are waiting for beside they really don’t have a legitimate argument because where it is similar, it’s not the same and definitely not a copy.
Why MLB Trademark Dispute Is Not Justified?
When I first heard of this dispute the first thing that came to mind was my post on Overused and Abused Logo Design! There are many logos that utilize this technique and with all do respect it’s not creative anymore. For instance the NBA (National Basketball Association), MLG (Major League Gaming), NICA (National Interscholastic Cycling Association), AMA Motorcross, AHL (American Hockey League) which uses a circle but is till similar and many other logos that use the same design technique as the MLB logo. Many of these over used logos all use the same color scheme, at least Overwatch League went with a different colors scheme and can definitely not be confused with the MLB logo. This is a very common practice for a business to choose a shape, cut a silhouette out and choose to colors for the opposing sides. MLB can trademark the silhouette and exact design on their logo but I don’t think they can trademark the technique. I think the overall lesson here is remember logo design still requires creativity!
